Le régime de lutte contre les logiciels antifraude sera assoupli
Face à l’inquiétude notamment des petites entreprises sur leur obligation de s’équiper de logiciels antifraude à compter du 1er janvier 2018, le ministre de l’action et des comptes publics promet des assouplissements.
Nouvelle obligation à compter du 1er janvier 2018
A compter du 1er janvier 2018, les assujettis à la TVA qui enregistrent les règlements de leurs clients au moyen d’un logiciel de comptabilité ou de gestion ou d’un système de caisse devront utiliser un logiciel conforme répondant à des conditions d’inaltérabilité, de sécurisation, de conservation et d’archivage des données.
L’obligation concerne tous les assujettis à la TVA, personnes physiques ou morales, de droit privé ou de droit public. Elle concerne donc également les assujettis dont tout ou partie des opérations réalisées sont exonérées de TVA ou qui relèvent du régime de la franchise en base de TVA.
Le dispositif vise tout matériel qui permet d’automatiser des calculs et de mémoriser des opérations d’encaissement : les logiciels de comptabilité, les logiciels de gestion et les systèmes de caisse. Le défaut de production de l’attestation ou du certificat est lourdement sanctionné (amende de 7 500 €).
Simplification attendue
Face à l’inquiétude exprimée par les entreprises, notamment les micro-entreprises, quant à la mise en oeuvre du dispositif au 1er janvier 2018, le Ministre de l’Action et des Comptes publics a décidé de le recentrer et de le simplifier.
Seuls les logiciels et systèmes de caisse, principaux vecteurs des fraudes constatées à la TVA, seront ainsi concernés. Les logiciels de comptabilité et de gestion seraient donc exclus du périmètre de l’obligation.
Cette modification fera l’objet de mesures législatives d’ici la fin de l’année, pour une entrée en vigueur du dispositif comme prévu au 1er janvier 2018. Les entreprises qui n’auraient pas encore effectué cette mise en conformité de leur logiciel de caisse ont ainsi 6 mois pour y veiller.
Organismes accrédités pour la conformité des logiciels ou des systèmes de caisse
Les entreprises assujettis à la TVA devront être en mesure de remettre à l’administration lors d’un contrôle inopiné une preuve de la conformité du logiciel. Celle-ci prend la forme :
– d’un certificat délivré par un organisme tiers accrédité (attestation d’homologation par un tiers habilité à conduire des audits de certification du haut niveau de sécurité) ;
– d’une attestation individuelle de l’éditeur selon laquelle le logiciel est sécurisé, et conforme à un modèle fixé par l’administration.
L’administration fiscale n’est pas un organisme accrédité qui délivre les certificats. Deux organismes sont accrédités par le COFRAC, instance nationale d’accréditation, à la date du 30 mai 2017 :
– AFNOR certification, accréditation n° 5-0030
– Laboratoire National de Métrologie et d’Essais (LNE), accréditation n° 5-0012
